General Terms and Conditions
Important: These terms apply to business customers and consumers. Mandatory consumer protection rules in the consumer’s country of habitual residence remain unaffected.
1. Supplier and scope
The supplier is NKFelektrotechnik s.r.o., Kľakovská ulica 880/13, 966 81 Žarnovica, Slovakia, Company ID 54817471, VAT ID SK2121794389. These terms cover design, manufacture, delivery, electrical and photovoltaic installation, commissioning, testing, maintenance and service.
2. Contract and documents
The website is not a binding offer. A contract is formed by written confirmation, signature or performance following an express order. Individual agreements and the confirmed quotation prevail over technical documents and these terms. VOB/B, ÖNORM B 2110 and third-party terms apply only when expressly agreed and supplied before contract formation.
3. Scope and changes
Only work stated in the confirmed quotation is included. Variations and additional work should be agreed in text form and may affect price and timing. Urgent measures necessary to prevent immediate damage may be performed to a reasonable extent when prior approval cannot be obtained.
4. Customer cooperation
The customer must provide correct plans, safe access, required shutdowns, workspace, utilities and customer-side permits, and disclose known hazards and concealed services. The customer bears delays and additional costs caused by a failure for which the customer is responsible.
5. Dates, prices and payment
A date is binding only when expressly confirmed as binding. Deadlines are reasonably extended by force majeure, supply disruption, authority action, unforeseen site conditions or customer-caused obstruction. Consumer prices include VAT; business prices exclude VAT unless stated otherwise. Invoices are payable by the stated date, or within 14 calendar days if no date is stated.
6. Handover, defects and warranty
Work subject to acceptance is inspected and, where practical, recorded in a handover report. Mandatory statutory remedies for defects apply. The customer should describe defects promptly and permit inspection and cure; this request does not restrict consumer rights. Normal wear, misuse, unauthorised third-party changes and customer-supplied defective materials are excluded where the supplier is not responsible.
7. Liability
Liability is unlimited for intent, gross negligence, death or personal injury and where mandatory law requires. For slight negligence affecting an essential contractual obligation, liability is limited to typical foreseeable loss where legally permitted. Mandatory consumer rights remain unaffected.
8. Work in Germany and Austria
Mandatory technical, safety, construction, trade, employment and posting rules at the place of performance apply. The quotation or contract assigns responsibility for required notifications, recognitions and permits.
9. Consumers and withdrawal
Before contracting, consumers receive clear information on the service, total price or calculation method, payment, performance, duration and any guarantee. Distance and off-premises contracts generally carry a statutory withdrawal right. Work before the withdrawal period expires starts only at the consumer’s express request. A proportionate statutory amount may be due for work already performed. The right ends after full performance only where all statutory conditions and confirmations are met. Custom-made goods and expressly requested urgent repairs are subject to statutory exceptions, which do not automatically cover the entire installation contract.
10. Complaints, law and jurisdiction
Complaints may be sent to nkfelektrotechnik@icloud.com. Consumers may use the competent alternative dispute resolution body or European Consumer Centre. Slovak law applies and the CISG is excluded, without depriving consumers of mandatory protection in their country of habitual residence. Courts at the supplier’s registered office have jurisdiction over business customers where permitted; statutory jurisdiction applies to consumers.
Right of withdrawal
Information for consumers
For a distance or off-premises contract, you generally have the right to withdraw within fourteen days without giving a reason. For services, the period generally begins when the contract is concluded; for goods, it generally begins upon receipt. Mandatory national exceptions and longer periods remain applicable.
To withdraw, send a clear statement to NKFelektrotechnik s.r.o., Kľakovská ulica 880/13, 966 81 Žarnovica, Slovakia, e-mail nkfelektrotechnik@icloud.com, telephone +421 948 815 014. Sending the statement before the deadline is sufficient.
Payments refundable by law will be returned within fourteen days after receipt of the statement. If services began at your express request before the withdrawal period expired, you may be required to pay the legally permitted proportionate amount for work already performed.
